Terms and Conditions of Use

1. About Trocah

Trocah is an online platform that connects people interested in trading goods and services with one another. Trocah does not sell products, does not perform the advertised services, and is not a party to the trades arranged between users.

2. Acceptance and Changes to These Terms

These Terms govern the relationship between Trocah and the people who use its services ("Users"). A User accepts these Terms from the moment they register and begin using the platform.

Whenever material changes are made to these Terms, we will give notice through the platform at least 10 (ten) calendar days in advance, so that the User can review them before the changes take effect. Under no circumstances will changes affect trades that have already been completed.

A User may close their account at any time, provided they have no pending obligations to Trocah or to other Users.

3. Capacity

People aged 18 or older, with legal capacity to enter into contracts, may use Trocah.

The platform is intended for adults 18 and older. Age is not currently verified with identity documents during registration. [TO BE DEFINED: legal review of this rule.]

4. Registration and Account

To use Trocah, you must create an account with true and up-to-date information. The User is solely responsible for the accuracy of the information provided.

Each person may hold only one account.

The account is personal, unique, and non-transferable: it may not be sold, rented, assigned, or shared with third parties in any form.

You are responsible for keeping your password confidential and for everything done through your account, including actions by third parties who access it with or without authorization.

In the event of unauthorized use of your account, you must notify Trocah immediately.

Some actions, such as completing trades, require a complete profile and facial photo verification.

Trocah may refuse a registration or cancel one already accepted due to a breach of these Terms, a request from a competent authority, or to prevent risk to the platform or to third parties, without this giving rise to any right to compensation.

5. How the Platform Works

You list products you own or services you know how to provide.

Other people find your listing and may propose a trade.

A trade may be direct (item for item) or use TrocaH Coins.

Users communicate through Trocah's chat and arrange delivery, a meetup, or shipping.

A trade is completed once both parties confirm it in the app.

6. TrocaH Coins

TrocaH Coins are internal credits, usable only within Trocah.

They are not money, do not earn interest, and cannot be withdrawn or converted into cash.

They are non-refundable under any circumstances.

Buying, selling, or trading TrocaH Coins for money or any other value outside the platform, whether between Users or with third parties, is prohibited. This conduct is considered an attempt to circumvent Trocah's rules and subjects the account to the sanctions set out in Section 16.

7. Premium Subscription

Trocah offers an optional subscription (Premium Plan), billed through the Hotmart payment platform. Basic use of Trocah does not require a subscription. Billing, cancellation, and refund terms for the Premium Plan follow what is displayed at the time of purchase and Hotmart's own rules; Trocah does not process payments and is not responsible for payment-processing failures.

8. Rules for Listing Products and Services

Only list items you actually own or services you actually know how to provide.

Describe the product's condition honestly and use real photos.

Do not post listings offering items for sale in exchange for real money. Trocah's purpose is trading.

Do not post offensive or misleading content, or content that infringes the rights of third parties.

Trocah may automatically suggest a category, tags, and a value in TrocaH Coins. These suggestions are only a reference and may be changed by you.

9. Rules for Completing Trades

The terms of each trade are arranged directly between the people involved.

Confirm the trade in the app only after receiving what was agreed upon.

For in-person meetups, prefer public, busy locations.

For shipments, each person is responsible for packaging and shipping their own part of the trade.

10. Responsibility for Published Information

Each user is solely responsible for the information, photos, and descriptions they publish. Trocah does not pre-screen every listing and does not guarantee the quality, safety, or legality of the items and services offered.

11. User Responsibility in Negotiations

Negotiations take place between users. Each person is responsible for evaluating the other party, inspecting the product or service, and honoring what was agreed upon. If a problem arises, use the report button or contact support.

12. Limitation of Platform Liability

Trocah acts exclusively as a technological intermediary, connecting people interested in trading goods and services. To the extent permitted by law:

Trocah is not liable for anything that occurs outside the platform, including, without limitation: a product delivered with a defect, a product not delivered, a mismatch between what was advertised and what was received, or any other issue arising from a meetup, shipment, or negotiation arranged directly between Users.

Trocah is not liable for damages arising from trades between users, for false information posted by third parties, or for temporary service unavailability.

13. Prohibited Conduct

Using the platform to sell products or services for money.

Buying, selling, or trading TrocaH Coins for money outside the platform.

Harassing, threatening, discriminating against, or offending other people.

Creating fake accounts or impersonating another person.

Sending spam, scams, or malicious links.

Attempting to circumvent the platform's security, TrocaH Coins balances, or rules.

Using automated systems (bots, spiders, scrapers, or crawlers) to access, extract, copy, or reproduce Trocah's content without express authorization.

14. Fraud and Attempted Fraud

Any attempt at fraud, such as advertising nonexistent items, failing to deliver on a trade in bad faith, or manipulating balances, may result in immediate account suspension and may be reported to the competent authorities, where applicable.

15. Prohibited Products and Services

Weapons, ammunition, explosives, and their components.

Drugs, controlled medications, and illicit substances.

Stolen, counterfeit, or pirated products.

Live animals.

Adult content or services of a sexual nature.

Third-party personal documents, personal data, or access accounts.

Any item or service prohibited under Brazilian law.

16. Sanctions

In the event of a breach of these Terms or applicable law, Trocah may warn, suspend, restrict, or disable the User's account, temporarily or permanently, without prejudice to other applicable measures. The following constitute violations, among others: selling or sharing an account, trading TrocaH Coins for money, and unauthorized automated use of the platform.

17. Indemnification

The User shall indemnify and hold Trocah, its partners, officers, and staff harmless against any administrative or judicial claim brought by other Users, third parties, or any entity, arising from the User's activity on the platform. [TO BE DEFINED: offsets and balance holds require legal review and are not automated on the platform.]

18. User-Published Content and Intellectual Property

By posting photos, text, and messages, you represent that you have the right to use them and you authorize Trocah to display them within the platform solely for the operation of the service. You remain the owner of your content.

The Trocah brand, logo, design, and software belong to their respective owners and may not be copied, reproduced, or used without authorization.

19. Automated Use and Access to Information

Using automated systems to access, index, extract, copy, or reproduce any Trocah content without express authorization is prohibited, including content protected by intellectual property rights, personal data, and features that require login. Trocah may limit or block such use and pursue applicable legal remedies.

20. Data Privacy

Trocah makes responsible use of Users' personal information, as detailed in the Privacy Policy.

21. Account Suspension or Termination

Trocah may remove listings, temporarily block, or ban accounts that violate these Terms, following a review of reports or the identification of irregularities. You may withdraw your listings at any time and request the closure of your account by contacting us at our support email.

22. Protection of Children and Adolescents

To report any violation of the rights of children or adolescents identified on the platform, email trocah.contato@gmail.com.

23. General Provisions

If any clause of these Terms is found to be invalid or unenforceable, the remaining clauses shall remain in full force and effect.

Trocah is not liable for unavailability resulting from causes beyond its reasonable control (third-party infrastructure failures, force majeure events, etc.).

Trocah's tolerance of a breach of any clause does not constitute a waiver of its right to enforce that clause later.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil, including the Consumer Protection Code (Código de Defesa do Consumidor) where applicable. Users who qualify as consumers may bring claims in the court of their own domicile. For all other disputes, the parties elect the courts of Santos, São Paulo - SP, Brazil.
